Development of a National Regulatory Framework

In March 2008, Housing Ministers endorsed a proposal for a PDF National Regulatory Framework (363Kb) for not-for-profit housing providers involved in growth activities, which was based on the introduction of mutual recognition principles and the harmonisation of legislative and administrative arrangements across jurisdictions over time.

Since this initial development work on the National Regulatory Framework, the housing policy environment has changed significantly with the introduction of Commonwealth initiatives such as the National Rental Affordability Scheme and the Nation Building - Economic Stimulus Plan. These initiatives are expected to result in rapid growth of the not-for-profit housing sector and the emergence of a broader range of affordable housing providers.

As a result, a re-scoping project was undertaken to assess whether work completed to date remains the right approach to regulation in the current national housing policy environment.

Workshops were held in May 2009 in Sydney, Melbourne and Canberra to seek the views of sector representatives from across Australia in relation to six options for a national regulatory system. Commonwealth, State and Territory Housing Ministers will consider a final report in September 2009 to determine a final position on a national regulatory system.

The benefits of a national regulatory system for housing providers include the reduction in barriers to operating across jurisdictional boundaries; reduction in administrative costs of regulation by having a consistent system; and securing the reputation of the not-for-profit housing sector as having high regulatory standards.
